英語の授業中、外国語指導助手（ＡＬＴ）と日本人教員が言葉を交わさない――。ＡＬＴを業者への業務委託（請負）で確保する自治体で、奇妙な授業風景が繰り広げられている。２人が協力して授業に取り組むと「偽装請負」（労働者派遣法違反）となってしまうからだ。ルールを守れずに労働局から指導を受ける教育委員会が相次ぎ、教室で混乱が起きている。

　「先生、英語ばっかりでわからへん」。関西のある小学校。子どもたちが教室の端で待機していた担任の方を振り返って騒ぎ出した。女性指導助手は早口の英語で授業を始めた。日本語はほとんど理解できなかった。

　「日本語がわかる人が来ると思っていたので驚いた」と担任。助け舟を出したくても出せない。「先生じゃなくてＡＬＴさんに言って」と子どもに伝えたが、騒々しさは増すばかり。ルール違反を承知で、通訳して一緒に授業を進めるしかなかった。

　「授業中に口ははさめません」「レッスンプランの打ち合わせはできません」――。

　労働局から４月に偽装請負の是正指導を受け、外国人講師の授業が７月初旬までストップした千葉県柏市。授業再開前に各校からの質問が殺到し、市教委が作った一問一答集の項目は１００を超えた。業務委託が適法かどうかの分かれ目は、教員が指揮命令しないこと。講師の授業に問題があっても直接言わず、業者から改善指導してもらうように、との注意が繰り返される。

Recently, primary schools started teaching English back in Japan. Since most elementary school teachers are not trained for teaching English, schools hire English teachers who are native speaker as special lecturer, so called ALT (Assistant Language Teacher). So typically, there are both Eng. teacher and Japanese teacher in English class.

To hire the Eng. teacher, there are two options. Primarily option is that school or school committee of the city hire ALT. Second option is use agency and let them organize English class. It is outsource.

But there is a stupid legal rule for collaborating these teachers. The stupid rule is that: When school have a ALT trough agency, Japanese teacher of the school is not allowed to cooperate with the Eng teacher in the class. Legally, if you did outsourcing, you cannot help ALT who came from outsource company. Strictly, it would not be truly "outsourcing" if you help them.

However in most case, ALT, who is native English speaker is not good at communicating in Japanese. So if Japanese teacher didn't help ALT to communicate in Japanese with students, it just confuse children. In fact, most of children cannot understand what Eng teacher said in English so that they asked Japanese teacher what Eng teacher said.

But legal rule doesn't allow Japanese teacher to help the ALT. So legally, Japanese teacher cannot say anything in the English class. Government is trying to force teachers to follow their stupid rule. They don't think what's the important thing for children, but just strict.

Problem is that, it is cost effective if school used agency to have ALT. If school hire ALT directly, school or school committee of the city is required to support ALT's life, i.e. housing. Most of ALT came from abroad, it is important for them to have someone to take care of their life setting up. Since the agency takes care of everything for ALT's life, it is easy for school and city. So many of school use agency to have ALT. But once they got outsourcing ALT teacher, school cannot help anything in their class because of the stupid rule.

Such a carzy rule! What Japanese government does are always like that. That's so bad.
